Do Cash, Venmo, or Direct Payments Count for Child Support?

By SupportDecode Editorial Team. Published . Sources verified .

What Texas and Illinois child support agencies say about paying directly with cash or payment apps, and required payment documentation

Paying the other parent directly does not count automatically. The court order specifies the payment method. The state agency keeps the official ledger. Payments made outside that channel can leave the balance unpaid.

Child support orders specify how to pay. Cash handoffs and app transfers do not post to the state ledger on their own. This article covers Texas and Illinois only; rules in other states can differ, and the court order’s own wording matters.

What Texas and Illinois agencies say about direct payments

State child support agencies track the official payment balance. In Texas and Illinois, the agencies give specific instructions on direct payments and how parents can seek credit:

The risk of payments being treated as a gift in Texas

In Texas, support payments go through a local registry or the State Disbursement Unit (Tex. Fam. Code §154.004). Most orders state the obligation is satisfied only by paying as prescribed. They warn that any other payment will be treated as a gift.

A gift does not count as support. The official balance stays unpaid on the state ledger. The Office of the Attorney General investigates discrepancies between SDU records and party records (Tex. Fam. Code §234.0091). The parent claiming credit must provide documentary evidence of payment.

Record types the agencies name for credit

When parents ask for credit for direct payments, the state agencies name specific records to establish proof:

  • Texas: The paying parent lists dates and amounts on Form 1A007e (Certification of Direct Payments). The form states credit is not received until agreed to by the custodial parent or approved by the court. It reminds parents that child, medical, and dental support go to the State Disbursement Unit. The custodial parent can submit an Affidavit of Direct Payments. That affidavit covers direct payments received in any form, including cash or check. It excludes payments made through a registry or SDU.
  • Illinois: Under FAQ #9, parents submit records to the servicing Regional Office. The agency names money orders, check copies showing both sides, and payment-app printouts (such as Venmo).

What happens if direct payments are not credited

Uncredited direct payments leave past-due support on the ledger. Those unpaid amounts become arrears. See the child support enforcement guide for collection rules. Questions parents ask

Do cash or Venmo child support payments count automatically?

Not automatically in Texas or Illinois. Texas gives no credit until the receiving parent agrees or a court approves, and Illinois asks for payment records sent to the CSS Regional Office.

Can direct child support payments be treated as a gift in Texas?

Yes. The Texas Attorney General Criminal Nonsupport Handbook notes that most orders warn payments made outside the local registry or State Disbursement Unit will be treated as a gift.

How do you get credit for direct payments in Illinois?

Illinois HFS FAQ #9 states parents must provide documentation such as money orders, copies of both sides of checks, or printouts of Venmo or other online payment methods to the servicing CSS Regional Office.

Can you pay child support directly instead of wage withholding in Illinois?

No. Illinois HFS FAQ #2 states that paying through income withholding is the law, and parents cannot pay directly instead of withholding.
