N.D. Admin. Code chapter 75-02-04.1 defines net income, rounds it to the nearest $100, and assigns a monthly amount by number of children.

The published table runs from $800 or less through $25,000 or more and has columns for one through five children and six or more.

Different calculations apply when parenting time exceeds 100 overnights, responsibility is equal, or children primarily live in both homes.

Worked example: equal responsibility

  1. At $4,000 net income, the two-child table amount is $1,131.
  2. At $3,000 net income, it is $846.
  3. The equal-responsibility offset is $285 monthly from the parent with the higher table amount.

The obligation table uses monthly net income determined under the guideline definition and deductions.

How is income rounded?

Net income is rounded to the nearest $100; an exact $50 midpoint rounds to the next higher row.

What happens below $800?

The $800-or-less row applies and shows zero in the base table, subject to the court rules and case facts.

What happens above $25,000?

The published $25,000-or-more row supplies the table amount, but the rule permits an upward deviation in qualifying cases.

How does extended parenting time work?

For more than 100 and fewer than 183 overnights, the table obligation is multiplied by (365 minus overnights times 0.32) divided by 365.

How does equal responsibility work?

The table obligation is computed for each parent and the lower amount is offset against the higher amount.
