Short answer: no. Child support and parenting time are separate issues. Missed visits do not cancel a support payment. New York’s child support guide says so in almost those words. Texas says it from the other side. The parent with custody still has to follow the visitation order when support is unpaid.
Stopping payments only builds a balance. Illinois tells parents the order to pay continues until a court changes it. Payments should keep going while a modification is pending.
What the child support agency will and will not do
Most parents call the child support office first. It is the office they already know. Four state agencies say plainly that visitation is not their job:
| Agency | What it handles | What it says about visitation |
|---|---|---|
| California Department of Child Support Services | Child support orders and payments | Offices cannot handle custody or visitation matters |
| Illinois Healthcare and Family Services | Child support services and income withholding | Does not assist with visitation issues and refers parents to a private attorney |
| New York Office of Temporary and Disability Assistance | Child support services | Visitation problems go to family court through a petition for a visitation order |
| Texas Office of the Attorney General | Enforcing child support orders | Cannot and does not enforce visitation orders; runs an Access and Visitation Hotline |
Where a parent with blocked visits can turn
The routes the agencies themselves point to:
- New York: a petition for a visitation order in family court.
- Texas: the Access and Visitation Hotline, (866) 292-4636. It answers in English and Spanish on weekday afternoons. There is also the TXAccess site.
- Illinois: the child support program refers visitation questions to a private attorney.
- California: a change in custody or in each parent’s time can be a reason to ask the court to change support. The local child support agency can also help with that request.
Rules and court forms differ by state and county. Confirm the exact steps with the court that made the order, or with a family law attorney there.
What happens to the support balance meanwhile
Missed payments become arrears. In many states, arrears carry interest. The child support enforcement guide covers passport and license consequences in the states it reviews. The state arrears calculators show how a balance grows under each state’s rules. If the parenting arrangement has changed for good, that is a modification question. See when child support can change.
Questions parents ask
Can I stop paying child support if the other parent denies visitation?
No. Support and visitation are separate issues. Unpaid amounts keep building as arrears. Illinois notes the order to pay continues until a court changes it.
Can a parent deny visitation because child support is unpaid?
The Texas Attorney General's FAQ says the custodial parent must follow the visitation order even if support is not being paid.
Will the child support agency enforce my visitation order?
The California, Illinois, New York and Texas agencies all say they do not handle or enforce visitation. Texas runs a separate Access and Visitation Hotline.
